By downloading, installing, accessing, or using Arbori: Ai Plant Identifier (the “App”) provided by Arbori: Ai Plant Identifier (“Company,” “we,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the App.
2. Description of the Service
The App provides:
An AI-powered chat feature (“Talk to a Botanist AI”)
Plant identification and analysis tools
Plant health and care recommendations
We offer both free and premium features, including weekly and annual premium subscription plans, managed through third-party service providers (e.g., RevenueCat).
3. Eligibility
You must be at least 13 years old (or older if required by your local jurisdiction) to use this App. By using the App, you represent that you meet the applicable age requirements.
4. Intellectual Property Rights
All content, trademarks, logos, and other intellectual property within the App are owned by Arbori: Ai Plant Identifier or its licensors. You agree not to copy, reproduce, distribute, or create derivative works from any part of the App without our express written permission.
5. User Conduct
You agree not to use the App for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the App. You must not attempt to gain unauthorized access to any systems or networks associated with the App.
6. Premium Subscriptions
Premium subscriptions, available on a weekly or annual basis, are managed through third-party providers (e.g., RevenueCat) and adhere to the payment and cancellation terms set forth by the App Store. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
7. Disclaimers
The App’s plant analysis, recommendations, and AI chatbot responses are provided for informational and educational purposes only. They are not intended as professional medical or horticultural advice. You should consult a qualified professional for serious plant health issues or questions. The App is provided “as is,” without warranties of any kind, express or implied.
8. Limitation of Liability
Under no circumstances shall Arbori: Ai Plant Identifier be liable for any indirect, incidental, consequential, or exemplary damages arising out of or related to your use of the App. Your sole and exclusive remedy for dissatisfaction with the App is to stop using it.
9. Indemnification
You agree to indemnify and hold harmless Arbori: Ai Plant Identifier, its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the App or any violation of these Terms.
10. Changes to Terms
We may update these Terms from time to time. The most current version will be posted in the App or on our website. By continuing to use the App after changes are posted, you agree to the updated Terms.
